1. Scope

1.1. These general terms are applicable to the by SkiWebShop, Laagsteen 28, 4815PH Breda (hereafter: “Provider”) organized promotion ‘Black Friday Early Access’ (hereafter: “promotion”) for the promotion of SkiWebShop

1.2. The promotion will be held until the Provider decides to stop the promotion.

1.3. The promoter reserves the right to terminate, interrupt or modify the promotional campaign, at its own discretion and without any prior notification, and/or to change the Terms and Conditions governing Promotional Campaigns and/or the prizes, if circumstances arise rendering this necessary, without being obliged in any way to indemnify Contestants.

1.4. The Terms and Conditions have been translated from Dutch to English as a courtesy. In the event of differences of interpretation, the Dutch version shall prevail and shall be binding between the Parties.

 

2 Participation

2.1. To enter the promotion you have to leave your email address in the correct form.

2.2. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

2.3 Participation is free of charge.

2.4. If the contestant does not meet the eligibility requirements or is subject to any entry restrictions, that Contestant shall not be entitled to the discount.

 

3. The Promotion

3.1 The Promotion is only valid onto products with a Black Friday label. SkiWebShop will assign a label in the bottom left corner with the text: Black Friday

3.2 The Promotion is not valid on ski’s, ski simulators and braces.

3.3 The Promotion is not valid on Toni Sailer, Sportalm, Stox, Picture and Peak Performance

3.4 The Promotion is not valid until Sunday, the 24th of November 2024, 23:59 CET.

3.5 After Contestant left his/her email address, only then Contestant will receive an email with a voucher which Contestant may use on the products specified in paragraph 3.1 and 3.2.

 

4. Copyright and moral rights

4.1 You warrant to us that you created your competition entries, that you own all of the copyright in those entries, and that our use of the entries in accordance with these rules will not infringe any person's intellectual property rights or other legal rights.

4.2 You grant to us, SkiWebShop, an exclusive, worldwide, royalty-free, perpetual and irrevocable licence to copy, store, edit, distribute, transmit and publish everything that is related to the promotion, i.e. photographs and names on our website, our social media pages and the newsletter of SkiWebShop.

4.3. By entering this contest, the Contestant consents to the Providers and its service providers using and processing the Contestant’s personal data in connection with the contest and in accordance with Providers privacy policy or otherwise as required by law or regulation. In addition, the Contestant permits the Providers to use the Contestant’s personal data for any commercial purpose and to publish the Contestant’s submissions and/or his personal data in various media for publicity purposes.

 

5. Liability

5.1. By entering you agree to release and hold harmless SkiWebShop and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such contestant’s participation in the promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

5.2. If, despite the stipulations in paragraph 5.1, the Provider’s liability for damages suffered by a Contestant must be accepted the Provider’s obligation to reimburse the damages in question remains limited to the amount the Provider’s insurance company will pay in respect of the claim.

5.3. Provider is not liable for damages caused for example the loss or the misplacement of contestant’s information.

 

6. Disputes

6.1. This promotion is governed by the laws of The Netherlands, excluding the Vienna Trade Treaty. As a condition of participating in this Promotion, Contestant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, exclusively before a court located in The Netherlands having jurisdiction. Further, in any such dispute, under no circumstances will Contestant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Contestant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveway), and Contestant further waives all rights to have damages multiplied or increased.

6.2. As mentioned in paragraph 1.5 the Terms and Conditions have been translated from Dutch to English as a courtesy. In the event of differences of interpretation, the Dutch version shall prevail and shall be binding between the Parties.
